6. Unsolicited Creative Submissions

Digital Ignition does not accept unsolicited screenplays, scripts, treatments, story ideas, television concepts, film concepts, character concepts, pitch decks, creative proposals, or other creative materials through the Site unless Digital Ignition has specifically requested the submission.

Please do not use the Site's general contact form to submit unsolicited creative materials.

If you nevertheless submit unsolicited creative material without a separate written submission agreement:

  • Digital Ignition has no obligation to review, evaluate, respond to, retain, or return the material;
  • Submission of the material does not create a confidential, fiduciary, agency, producer, writer, representation, or other special relationship;
  • You acknowledge that Digital Ignition and persons with whom we work may already be developing, reviewing, or considering projects, themes, concepts, characters, stories, or ideas that are similar to your submission;
  • You will not claim that the mere similarity of an independently developed project creates liability or establishes that Digital Ignition used your submission; and
  • You retain whatever intellectual-property rights you otherwise possess in your original material, subject to these Terms and applicable law.

Nothing in this section gives Digital Ignition ownership of your copyrighted creative material merely because you submitted it through the Site.

7. Intellectual Property

Unless otherwise indicated, the Site and its contents are owned by, licensed to, or used with permission by Digital Ignition.

Site content may include:

  • Text;
  • Graphics;
  • Logos;
  • Trademarks;
  • Trade names;
  • Photographs;
  • Film imagery;

  • YOUR USE OF OR INABILITY TO USE THE SITE;

18. Governing Law

These Terms and any dispute arising from or relating to the Site will be governed by the laws of the State of New York, without regard to conflict-of-law principles.

To the extent a dispute may properly be subject to a contractual choice of forum, you agree that such dispute shall be brought in a state or federal court having jurisdiction over Digital Ignition's principal place of business in New York, and you consent to the jurisdiction of those courts.

Nothing in this provision eliminates any rights you may have under applicable consumer-protection law that cannot lawfully be waived.

19. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law, and the remaining provisions will remain in effect.

20. No Waiver

Digital Ignition's failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

21. Entire Agreement

These Terms and the Privacy Policy constitute the agreement between you and Digital Ignition concerning your use of the Site.

They do not supersede or modify any separately executed written agreement between you and Digital Ignition relating to a production, financing, investment, employment, vendor, partnership, or other business relationship.
